8. In this instance, the disputed CEA decision was taken on 5 May 2023 and notified on the same day; the deadline for lodging an appeal was therefore 19 May 2023.
This appeal, submitted on 24 May 2023, is therefore manifestly late and must be dismissed as inadmissible.
The IT connection difficulties invoked by the applicant are not of such a nature as to allow the Complaints Board to overlook this mandatory deadline the strict respect of which is a matter of public policy (“ordre public”).
9. The appeal can therefore only be dismissed as inadmissible.
